These Terms of Service (“Terms”) govern your use of Ømnimind. By creating an account you agree to these Terms. If you do not agree, do not use Ømnimind.
1. Eligibility
You must be at least 18 years old to create an Ømnimind account. Ømnimind is not designed for children, and we will close accounts we discover to belong to minors.
2. Not medical advice
Ømnimind is an informational tool, not a medical device or a healthcare provider. It does not diagnose conditions, prescribe treatments, or replace a clinician. Anything Ømnimind tells you is for educational purposes only. Always consult a qualified healthcare professional before making decisions about your health, medications, or treatment plans. Never disregard or delay medical advice because of something you read in Ømnimind.
If you believe you are experiencing a medical emergency, call your local emergency number immediately. If you are having thoughts of self-harm or suicide, contact a crisis line such as 988 (US) or your local equivalent.
3. Your account
You are responsible for the accuracy of the information you provide and for keeping your password confidential. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at security@omnimind.app.
4. Your content
You retain ownership of the records, documents, and messages you upload (“Your Content”). You grant Ømnimind a limited, non-exclusive license to store and process Your Content solely to operate the service for you. We do not use Your Content to train or fine-tune third-party models.
You represent that you have the right to upload Your Content and that it does not violate any law or third-party rights.
5. Acceptable use
You agree not to:
- Use Ømnimind to harm yourself or others.
- Impersonate another person or upload content that belongs to someone else without authorization.
- Attempt to reverse-engineer the service, extract model weights, jailbreak the AI, or disrupt other users.
- Use Ømnimind to make decisions on behalf of someone else without their consent.
- Upload content that is illegal, defamatory, or infringes others' rights.
We may suspend or terminate accounts that violate these rules.
6. Credits and billing
Ømnimind uses a credit system. Purchases are processed through a third-party payment provider (currently Stripe). Credits are non-transferable and non-refundable except as required by law or as explicitly stated in our refund policy. If a chat or operation fails before producing a usable result, the credits consumed are automatically refunded to your balance.
7. AI accuracy and limitations
AI responses can be inaccurate, incomplete, or out of date. We run a secondary audit pass on responses to flag inconsistencies with your committed records, but no automated system catches every error. You agree to evaluate AI output critically and to never rely on Ømnimind for time-sensitive medical decisions.
8. Service availability and changes
We may change, suspend, or discontinue features at any time. We will give reasonable notice of material changes that affect paying users. We do not guarantee uninterrupted service.
9. Termination
You may delete your account at any time from the in-app settings. We may suspend or terminate accounts that violate these Terms or that appear to be fraudulent. On termination your access ends immediately and your data is handled as described in the Privacy Policy.
10. Disclaimers
Ømnimind is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or that AI output will be accurate.
11. Limitation of liability
To the maximum extent permitted by law, Ømnimind and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the service. Our total liability for any claim arising from these Terms or the service will not exceed the greater of (a) the amount you paid Ømnimind in the 12 months before the claim, or (b) US$50.
12. Indemnity
You agree to indemnify and hold harmless Ømnimind from any claim arising out of your violation of these Terms, your misuse of the service, or your violation of any law or third-party right.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable consumer-protection law gives you the right to bring claims in your home jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will notify you in-app and update the effective date above. Continued use after a change constitutes acceptance.
